When faced with a formal complaint of potentially “severe, pervasive, and objectively offensive” conduct, many of us question whether this definition of sexual harassment under Title IX would apply to the incident at hand. As practitioners have realized, this vague definition can cause confusion among even the most experienced Title IX Coordinators. In this session, Title IX Solutions Co-founder & Title IX expert, Patrick Mathis, and career Title IX Coordinator, Kathryn Statz, dive into the practical application of this abstract definition. Pat will delve into the rationale behind the Davis Standard and discuss relevant U.S court rulings, while Kathryn will share her own experiences wading through complaints involving this definition of sexual harassment. Together with participants, Pat and Kathryn will consider several factual scenarios and the role of the Title IX Coordinator in interpreting complaints.
